The Supreme court said the creativity and imagination of an author cannot be held hostage to the vagaries of subjective perception, whims and fancies of Individual.

With due respect to Supreme Court and the learned judges, I would love to understand following
     
   My lord, art and literature belong to subjective domain, how  can I or you have an objective opinion on it?

   My lord, if judges are really so objective in taking decisions,how does one bench overturns verdict of another?

  Your honour, creativity does not know boundaries, under such a situation, while giving shape to free flowing thoughts,

If a writer lands up degrading Indian Tricolour,

If a writer lands writing a sensuous story on “Nyay ki devi (blind)” and the Judges, depicting every minute details,

If a writer lands writing a love story on “pro phet” and “Mari am” ,

will you treat him in the same manner, will the society, will the nation treat him in the way shown by you or you will have some other perception based justification to award punishment to such writer?

Your honor, we all respect FOE, we all respect creativity, we all respect art and literature but one thing must be kept in mind that perception cannot be out rightly ignored.
